1. Mechanics liens — Necessary parties. It is well settled in this jurisdiction that in any suit seeking to enforce or establish the validity of a mechanics lien, the owner or person whose interest is sought to be charged is a necessary party to the action. 2. Mechanics liens — Defective lien. The claimed mechanics lien here was fatally defective where notice of lien stated that lien was for work in electrical wiring of building whereas labor and material were furnished for machinery and appliances not attached to a building, and debtor corporation was "Montana Fish Meal and Oil Corporation" and not "Montana Fish Meal Company" as was stated in the notice. 3. Mechanics lien — Definition — Platform not a structure here. The movable platform on which the machinery and equipment were placed is not a structure within the meaning of the provisions of Section 45-501 R.C.M. 1947. 4. Mechanics liens — Property held not lienable. The machines and motors attached to the platform were not fixtures and hence not real estate and lienable.
