1 Glen Arlen Hay, hereinafter referred to as Defendant, was charged by Information in the District Court of Roger Mills County with the crime of Assault and Battery with a Dangerous Weapon. The Information more specifically alleged that the defendant, on September 2, 1967, in said county, committed an assault and battery upon one Kenneth E. Rice by the use of shoes worn by the defendant and used by him in a manner likely to endanger the life of, and inflict great bodily injury to, this victim.
